Terms of Service

These Terms of Service ("Terms") govern your use of Delta ("we," "us," or "our"), a personal health coaching application available as an iOS app and related services. By creating an account or using Delta, you agree to these Terms. If you do not agree, do not use the application.

1. Description of the service

Delta is a health coaching application that aggregates biometric and fitness data from third-party sources — including Apple Health, Oura Ring, and Peloton — to compute daily recovery, training load, and strain scores, and to generate personalized coaching briefs powered by AI.

Delta also provides conversational nutrition logging, allowing you to track meals and macro intake via natural language.

2. Eligibility

You must be at least 16 years of age to use Delta. By using the service, you represent that you meet this requirement. If we learn that a user under 16 has created an account, we will terminate the account and delete all associated data.

3. Account and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at hello@usedelta.app if you become aware of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Third-party integrations

Delta connects to third-party services to retrieve your health and fitness data. These integrations are subject to the following conditions:

• Apple Health — Data is accessed on-device via Apple's HealthKit framework. You control which data categories Delta can read through iOS permissions.
• Oura Ring — Data is accessed via Oura's official OAuth API. You authorize specific data scopes during the connection flow and may revoke access at any time from your Oura account settings or from within Delta.
• Peloton — Workout data is accessed via Peloton's platform. You may disconnect this integration at any time from Delta's settings.

Delta is not affiliated with, endorsed by, or sponsored by Oura Health Oy, Apple Inc., or Peloton Interactive, Inc. Your use of those third-party services is governed by their respective terms of service and privacy policies.

5. Use of AI

Delta uses Claude AI (provided by Anthropic) to generate coaching brief text. When generating briefs, we send Anthropic anonymized daily metric summaries — not raw health records or personally identifying information. Anthropic does not use this data to train models.

AI-generated coaching content is informational only and does not constitute medical advice. See Section 8 (Disclaimer) below.

6. Acceptable use

You agree not to:

• Use Delta for any unlawful purpose or in violation of any applicable law
• Attempt to reverse-engineer, decompile, or disassemble the application
• Interfere with or disrupt the integrity or performance of the service
• Access another user's account or data without authorization
• Use the service to transmit malicious code or conduct automated scraping
• Resell, redistribute, or sublicense access to the service without our written consent

7. Intellectual property

All content, features, and functionality of Delta — including the scoring algorithms, coaching brief generation, user interface design, and branding — are owned by Delta and protected by applicable intellectual property laws.

Your health data remains yours. We claim no ownership over data you provide or that is imported from third-party integrations.

8. Disclaimer

Delta is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

9. Limitation of liability

To the fullest extent permitted by applicable law, Delta and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of the service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to these Terms or the service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.

10. Termination

You may stop using Delta and delete your account at any time. Upon account deletion, all associated health data, scores, briefs, and profile information will be permanently deleted within 30 days.

We may suspend or terminate your access to the service at our discretion if you violate these Terms, with or without notice. Upon termination, your right to use the service ceases immediately.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at the address associated with your account at least 14 days before the changes take effect. Continued use of Delta after that date constitutes acceptance of the updated Terms. The effective date at the top of this page reflects the most recent revision.

12. Privacy

Your use of Delta is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data. By using Delta, you acknowledge that you have read and understood the Privacy Policy.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration.
